Terms of Service.

These terms are the agreement between you and Fasholute for using our service. Please read them. By using the try-on or installing our widget on your store, you agree to them. If you don't agree, please don't use Fasholute.

There are two kinds of user here, and some sections are for one or the other. A shopper is anyone who uses the try-on on a store that has Fasholute. A merchant is a business that installs the widget and pays for it. Where a section only applies to one, it says so.

Who we are

Fasholute ("we", "us") provides this website (fasholute.com) and the virtual try-on service at app.fasholute.com, including the widget that stores embed on their product pages. You can reach us at hello@fasholute.com.

Using the try-on (shoppers)

The try-on is free for shoppers. You need to be 18 or over to use it. You upload a photo and we generate an image that shows a product on your body. How we handle that photo, and how quickly we delete it, is set out in our Privacy Policy.

When you use the try-on, you agree not to:

  • upload a photo of another person without their permission, or any photo of a child;
  • upload anything unlawful, infringing, hateful, or explicit;
  • upload an image you do not own or have permission to use;
  • try to reverse engineer the service, or use it to build a competing product or to train a model;
  • get around our rate limits, or use bots or scraping to overload the service.

AI results are approximations

Fasholute uses AI to generate try-on images. A result is a computer-generated approximation of how an item might look. It is not a promise about fit, size, colour, fabric, or availability, and it can get things wrong. Always check the store's own size guide before you buy. The purchase itself is between you and the store, not us.

Your photos stay yours

You keep ownership of any photo you upload. You give us a limited licence to use it only to generate and show your try-on result, for as long as we hold the image, which is a short window described in the Privacy Policy. We do not sell your photos and we do not use them to train AI.

Copyright and takedowns

Only upload images you own or have permission to use. If you believe something on Fasholute infringes your copyright, email us with the work concerned, where it appears, your contact details, and a statement that you are the rightsholder or are authorised to act for them. We will review it and remove infringing content. We can also remove any content and suspend any account that breaks these terms.

Accounts, plans, and billing (merchants)

To use Fasholute on your store you create an account and choose a plan. Keep your login details safe; you are responsible for what happens under your account. Payments are handled by Stripe, and full card details never touch our servers. Paid plans renew for the period you chose unless you cancel before the renewal. Fees exclude taxes unless we say otherwise. If you are a consumer buyer, your statutory cancellation and refund rights still apply; business plans are refunded only as our published policy or the law requires.

Your responsibilities as a merchant

You are responsible for your own store. That means you have the right to use the product images you show, you give your shoppers the privacy information the law requires, and you use Fasholute in line with the law and these terms. You must not present a try-on result as a guarantee of fit or as anything other than what it is.

Our intellectual property

Fasholute, the widget, this site, our software, and our branding are ours. While your account is active we give you a limited, non-exclusive, non-transferable licence to use the widget on your own store. You may not copy, resell, sub-license, or reverse engineer it.

Suspension and ending the service

You can stop using the try-on at any time, and a merchant can cancel their plan at any time. We can suspend or end access if these terms are broken, if it is needed to protect the service or other users, or if we are required to by law. If we end a merchant's paid plan without cause, we refund any fees covering time you no longer get to use.

Disclaimers

We work to keep Fasholute running well, but we provide it "as is". We do not promise it will always be available, uninterrupted, or error-free, and, as above, AI results are approximations. Nothing in this section takes away rights the law gives you that cannot be excluded.

Liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded under the law that applies to you. If you are a consumer, you keep every statutory right UK consumer law gives you, and nothing here affects them.

Beyond that, and to the extent the law allows: the try-on is free for shoppers, and we are not liable to a shopper for losses that were not a reasonably foreseeable result of our breach. For merchants, our total liability for any claim connected to the service is limited to the fees you paid us in the 12 months before the claim. We are not liable for lost profits, lost sales, or lost data that were not reasonably foreseeable.

Indemnity (merchants)

If you are a merchant, you agree to cover our reasonable losses if a claim arises from your breach of these terms, from content or product images you supply, or from your use of Fasholute in breach of the law.

Changes

We may update the service and these terms. If a change matters, we will update this page and the date at the top, and for significant changes we will give reasonable notice. If you keep using Fasholute after a change takes effect, that counts as accepting it. If you don't accept a change, please stop using the service.

Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living elsewhere in the UK, you can also bring a claim in the courts where you live. We are not asking you to give up the right to go to court, and these terms contain no forced-arbitration or class-action-waiver clause.
